OPINION BY JUDGE FRIEDMAN The Department of Transportation, Bureau of Driver Licensing (DOT) appeals from an order of the Court of Common Pleas of
Cambria County (trial court) sustaining Randy E. McQuaide's (Licensee) appeal and vacating the suspension of Licensee's operating
privilege imposed by DOT pursuant to 75 Pa.C.S. § 1547(b)(1) (refusal to submit to chemical testing). Following
a de novo hearing, the trial court found that, as a result of injuries sustained in an automobile accident on August 22, 1993,
Licensee could not knowingly and consciously refuse to submit to a blood alcohol test. 1 We affirm.
